On 4 March 2024, Chief Justice Helen Bowskill of the Supreme Court of Queensland’s new Practice Direction (Number 2 of 2024) will come into effect, which will dramatically improve how large and complex building, engineering and construction litigation matters are dealt with, called the Building, Engineering and Construction List (BEC List).

What is the new BEC List?

The BEC List will ensure your construction matter is listed with the Court and resolved in a just and speedy manner by identifying the issues in dispute early on. Expenses will be kept to a minimum as unnecessary delays in the form of interlocutory disputes will be avoided. And if your matter progresses to trial the BEC List will also ensure it is handled promptly.

Will my matter make it onto the BEC List?

While it is at the discretion of the BEC List Judge, it is likely your matter will be added to the BEC List if it involves:

• a substantial issue in relation to the design, carrying out, supervision or inspection of any building or engineering work;
• the performance by any engineering or building expert; or
• any certification, advice or information given or withheld in relation to building, engineering or construction.

It may also be that the very nature and complexity of the issue at hand requires judicial supervision under the BEC List.
